General Terms and Conditions – LusoDutch

These Terms and Conditions govern access to and use of the services of LusoDutch, an intermediation and recruitment consultancy specialized in the logistics sector, connecting transport professionals (Categories C, CE and D) to employers and agencies in the Benelux.

1. Purpose and Definitions

  • LusoDutch: The entity providing talent sourcing, screening and preparation services.
  • Client/Partner: Temporary employment agencies or transport companies that hire LusoDutch's intermediation services.
  • Candidate/Professional: Drivers and specialists recruited and prepared by LusoDutch.
  • Platform: LusoDutch's website and digital communication channels.

2. The LusoDutch Intermediation Model

LusoDutch acts as a Strategic Integration partner. Our service includes:

  • Rigorous technical recruitment and selection.
  • Language proficiency assessment (English).
  • Pre-departure briefing on safety standards and specific logistics procedures in the Netherlands.
  • Ongoing mediation support between the professional and the Dutch partner.

3. Use of the Platform and Applications

By submitting an application (Worker) or a contact request (Employer), the user guarantees that:

  • The information provided is truthful and complete.
  • In the case of drivers, they possess the necessary legal documentation (Driving License, CAM/Code 95) to perform the function.
  • LusoDutch reserves the right to refuse any profile that does not meet the company's "Professional DNA" standards.

4. Protection and Ethics Clause (Non-Circumvention)

This clause is vital to protect LusoDutch's business:

  • The Client/Partner undertakes not to hire directly, or through third parties, any Candidate presented by LusoDutch without our prior written consent, for a period of 12 months after the profile presentation.
  • Penalty: Breach of this clause will result in the payment of a compensation fee for "intermediation breach", stipulated in an individual contract or, in its absence, the standard amount of €10,000.00 per professional.

5. Operational and Legal Responsibilities

  • Workplace: Legal responsibility for the execution of work, workplace safety (PPE), accommodation and compliance with driving and rest time laws lies exclusively with the final employer or partner agency in the Netherlands.
  • Role of LusoDutch: We act as mediators and support. We are not responsible for traffic violations, material damage caused by professionals in the workplace or contractual breaches by the destination agency.

6. Data Protection (GDPR)

LusoDutch fully complies with the General Data Protection Regulation (GDPR).

  • Candidate data is shared with partners only for professional evaluation purposes.
  • The user has the right to request rectification or deletion of their data at any time through our official channels.

7. Intellectual Property

All website content (texts, logo, images and the "Strategic Integration" model) is the property of LusoDutch. Total or partial reproduction is prohibited without the express authorization of the Founder.

8. Termination and Suspension

LusoDutch reserves the right to suspend collaboration with Partners who:

  • Do not comply with the dignity standards in the accommodation provided to drivers.
  • Present repeated delays in payment of intermediation fees.
  • Do not respect the labor rights of integrated professionals.

9. Applicable Law and Jurisdiction

These Terms and Conditions are governed by Portuguese Law. For the resolution of any dispute, the parties elect the Court of the District of LusoDutch's headquarters, expressly waiving any other.
